COMMISSION AGREEMENT
Based on Florida Realtors form CA-8 (Rev 11/24)
[Seller Name] ("Seller") agrees that brokerage Certezza Realty LLC ("Broker") may show and will use diligent effort to sell Seller's Property located at [Property Address] ("Property").
Brokerage commissions are not set by law and are fully negotiable.
In the event the Property is sold, optioned, or contracted to be sold to any prospect procured by Broker, on the Termination Date or within 180 days thereafter, Seller agrees to pay Broker:
3.5% of the gross purchase price of the Property.
Seller will pay Broker's fee in the event of sale, at time of closing the sale. Broker's fee is due if Seller defaults on an executed sales contract with Consumer or if Seller agrees with Consumer to cancel an executed sales contract. In any litigation arising out of this agreement, the prevailing party will be entitled to recover from the non-prevailing party reasonable attorney's fees, costs, and expenses.
ADDITIONAL TERMS
This is a non-exclusive engagement. Seller may terminate this Agreement at any time upon written notice to Broker, subject to the 180-day Protection Period set forth above.
Broker's fee applies to any Buyer procured by Broker, whether introduced through Broker's Off-Market Buyer Registry or otherwise.
The Property will NOT be listed on the Multiple Listing Service (MLS) under this Agreement; Broker will market the Property exclusively through its off-market buyer registry and direct outreach. If Seller later elects to list the Property on the MLS, a separate Exclusive Right of Sale Listing Agreement will be executed.
Brokerage commissions are not set by law and are fully negotiable.
